
On November 20th, 2024, Professor Turčan presented to students and faculty at the William S. Richardson School of Law her ongoing research on aquaculture regulation. Professor Turčan explained to the well-attended audience what aquaculture is, how aquaculture impacts the health of marine waters and sustainable fisheries, how the law governing aquaculture is a bit unclear at the moment, and whether NOAA has the authority to regulate aquaculture following the overturning of Chevron deference.

Professor Turčan describes her research as placing the “particular case study of aquaculture within the larger context of how, post-Loper Bright, agencies will grapple with the scope of their legal authority to promulgate regulations governing new technologies not explicitly anticipated under the agencies’ enabling statutes. Is, for example, aquaculture a form of “fishing” as defined by the Magnuson-Stevens Act’s grant of authority to NOAA to manage the nation’s fisheries?”

Professor Turčan gave students an opportunity to react and participate in brainstorming academic legal analysis and to ask questions about recent case law from the United States Supreme Court. We look forward to seeing what her research unveils!
