Kealohanui: Know Plaintiffs land it belonged to Kikipina previously – now to Malahi. I had a water right. From early Monday morning to 5 P.M of each week. I have lived there 15 years and during that time the water has always been so. My land. Naholowaa and defendants had each one third of the stream during the above
hours. We used to go up very early 3 or 4 am to bring down the water. The land is know as Kaaipulalo. A portion of the land belongs to Mrs. Bishop and this land in dispute also got water from her land on Wednesday.
Defendants here made a statement that some of this land is higher than the other. The upper land gets the water from the upper stream. On Monday and on Wednesday from the lower stream.
Plaintiff says had he been informed that such was the case he would not have brought the care [partially blotted out].
Case adjourned till June 2 1880.
