A lot was chosen between the waterfront and downtown, owned by the government, which generously donated the lot. On May 3, 1855 the board was planning the building when they learned that Maxey had purchased the adjoining lot for a hotel (saloon). They were ready to but the lot from him at cost when they received assurance from the government that a liquor license would not be granted in 1856. This was before Maxey began building. The Privy Council made it official by passing an ordinance. Therefore, Maxey knew he would get no license in the future but built anyway. Now the government has gone back on its word to the great harm of the Sailor's Home Soc. Maxey writes that he first made an offer for the lot on June 1853 to S. Reynolds, was refused; made another offer in April 1855 and was accepted. On April 23 he checked to make sure the site was within the boundaries of liquor licenses; asked at Interior Dept., Atty. General and the Police. All assured him he was okay. So he paid his money and built before receiving the May 8 communication rejecting his license. Nobody offered to buy. Hopkins says the Royal is only 30 feet nearer the Sailor's Home than another hotel and that there are five hotels in easy distance of the home all with entrances by which sailors can enter unobserved more easily than the Royal. Hopkins also makes the point that it was not all that clear that the council would not issue another license to Maxey since the council asked the trustees of the Sailor's home to send a petition requesting this action.
