The Department of Homeland Security (DHS) has issued a final rule increasing USCIS premium processing fees to reflect inflation from June 2023 through June 2025. This biennial adjustment is mandated by the USCIS Stabilization Act to maintain service standards and address adjudication backlogs.

Effective Date: March 1, 2026

Under the new rule, the premium processing fee for Form I-129 (including H-1B, E-3, O-1, P-3, and TN classifications) and Form I-140 (employment-based immigrant petitions) will increase from $2,805 to $2,965.

Any premium processing request (Form I-907) postmarked on or after March 1, 2026, must reflect this new fee amount. The revenue from this increase will be used by USCIS to improve processing efficiency and fund overall adjudication and naturalization services.
