UPDATE: H-1B Filing Resumes – DOL Processing Sytem Reopened

We are pleased to report that the U.S. Department of Labor’s Foreign Labor Application Gateway (FLAG) system has reopened. We are now able to resume filing Labor Condition Applications (LCAs) for H-1B petitions.

Please note that the $100,000 fee is still in effect for all new H-1B petitions for individuals who are outside the U.S.

As stated in previous emails, this fee does not apply when filing the following petition types:

  • H-1B Extension Petitions (renewals of existing H-1B status)
  • Amendments to Current Visas (e.g., change of work location or change of job functions)
  • Change of Employer (beneficiaries must currently hold an H-1B visa with a different employer)
  • Change of Status from F-1, J-1, O-1, TN, or other nonimmigrant status to H-1B (beneficiaries must hold a valid nonimmigrant status)
